The Judge
orders, among other things, that Tom Padgett produce documents and that
he won't be held in contempt for non-payment of medical bills at this
point.
This shows that even when there is good
reason, the Judge doesn't rule reflexively against Padgett, and signs
an order tendered by Lola Lewis, Padgett's attorney. However, Judge Boteler
will have to return to these issues because Padgett does not pay for the
children's health care -- the care of the children he professes to cherish
-- as he has been ordered.
Also note point 6:
6. The Court ordered that both parties
not discuss the
divorce action with the children and should questions arise
regarding same from the children the parties are directed to change
the subject.
This is one of the many times this will
be mentioned and Tom Padgett refuses to heed the judge's order, as his

This matter being brought before the Court by both Petitioner
and Respondent on various motions on June 7, 1993, with both
parties being present with counsel, and the Court being
sufficiently advised;
IT IS HEREBY ORDERED AND ADJUDGED as follows:
1. Respondent shall have specific visitation for the summer
with the parties' minor children beginning Tuesday, June 15, 1993
through July 15, 1993;
2. All documents requested by Respondent in his previous
Requests for Production of Documents, including telephone
statements, shall be picked up on June 7, 1993 by Respondent's
Counsel or delivered to the Office of Hon. Pat Day, 28 Court
Street, Madisonville, Kentucky prior to the deposition of
Petitioner which is scheduled June 14, 1993, at 11:00 a.m. CST in
Madisonville, Kentucky.
3. The Respondent shall be responsible for the initial fee
resulting from the custodial evaluation requested by Petitioner and
to be performed by Donna Nichols, Psy.D., Associates in Counseling,
1802 South Virginia Street, Hopkinsville, Kentucky 42240. However,
the Court reserves any final decision as to payment determination

and will consider whether this cost is to be equally shared by the
parties at the final hearing.
4. The Court denied Petitioner's motion for contempt for
unpaid medical expenses and ordered that the parties resolve this
issue. Further, the parties were ordered to the grand jury room,
accompanied by the bailiff, to attempt to resolve the issue.
5. The Court rules that the Respondent's motion for contempt
of Petitioner regarding funds of some $2600.00 were moot since
these funds had already been escrowed. The Court stated motions
regarding these funds were not to be brought before this Court
until a final resolution of this case was to be heard. The Court
further requested that Attorney Lewis request that correspondence
to Judge Boteler from Attorney John Padgett be discontinued.
6. The Court ordered that both parties not discuss the
divorce action with the children and should questions arise
regarding same from the children the parties are directed to change
the subject.
